Terms of Agreement
This agreement is between Summer Rae Saif, owner of SummerRae Photography. Herein after SRP. Operating in the state of California, and the independent contractor whose name and address appears above, hereinafter the CONTRACTOR. This agreement is effective today (the date listed at the bottom) and will continue in effect for a period of 12 months or until such time as either party cancels the agreement in writing. At the end of designated period, the contract may be renewed for a one year period or may be extended for a longer period of time at the discretion of both par- ties.
Events
Contractor will be notified of jobs/assignments on a case by case basis. SRP is under no obligation to guarantee any minimum number of contracts or any minimum number of hours. All work performed by the intern for SRP at all times shall be governed by the covenants of this Agreement.
Contractor is required to show up on location 30 minutes prior to the event with all equipment ready to begin photographing the event (batteries, memory cards, lenses, phone charged)
Proper attire is required. Wearing all black, no low cut shirts or pants and comfortable shoes.
Contractor will be paid per hour the day of the event.
At the end of the event memory cards will be given to SRP and 20 minutes minimum to debrief
Position
The CONTRACTOR agrees to work for SRP as a work-for-hire independent contractor providing photography/assistant services on an as needed’ basis. The Contractor is a freelance working for him/ herself.
Contractor will seek to continue growing in their art by reading, watching, or attending photography related material. Completing assignments at an agreed upon time by both parties
Contractor will be informed of portrait shoots booked with SRP and the Contractor is invited to accompany SRP at anytime, solely to gain photographic experience unless otherwise agreed upon by both parties
SummerRae Photography's Position
SRP will provide opportunity for the Contractor to grow as a photographer through:
Mentorship
Onsite training
Paid events
Accountability to completed development
Unlimited access to SRP with any questions regarding photography, business and client interactions
Onsite assistance with free shoots booked by contractor

Independent Contractor
Independent Contractor: The CONTRACTOR and the SRP specifically agree that the CONTRACTOR is performing the services as an independent contractor and is not an employee by SRP. Nothing in this Agreement shall be construed as a guarantee of future employment or engagement, or as a limitation upon SRP's sole discretion to terminate this Agreement at any time without cause.
CONTRACTOR further agrees to be responsible for all of CONTRACTOR’s federal and state taxes, withholding, social security, insurance, and all other benefits.
Payment
Payments will be given to the contractor upon successful completion of events/sessions and memory cards given to SRP for editing.
Referrals- Contractor will receive 10% immediately after a contract has been signed by a client that mentions the contractor as their source for booking with SRP.
Events- The contractor will begin shooting events at $30 an hour. This does not include travel to and from the events. With continued growth and practice Contractor can earn more, working up to a maximum amount of $60 an hour.
Mini-Sessions- Contractor will receive $150 when working along side SRP for Mini-sessions. Where contractor is taking pictures of clients booked with SRP.
Sent out Sessions- In the event that the Contractor is sent out to shoot a session for a client that booked with SRP, the contractor will receive 30% of the amount paid by the client upon the completion of the session and the memory cards given to SRP for editing
Equipment
Contractor is only required to provide a camera body (and batteries for body) compatible with Canon lenses
The Contractor can use lenses owned by SRP at events/sessions booked by SRP.
All equipment (minus the body) will be provided by SRP should the contractor choose to use them. Memory cards and flash batteries will also be provided by SRP.
All equipment and lenses will be returned to SRP at the end of each session/event.
In the event that equipment is damaged while in the possession of the Contractor, they are responsible for replacing the equipment in an agreed upon amount of time by both parties
Exclusivity
The CONTRACTOR understands that he/she represents the SRP and not any other business while completing assignments for the SRP. While directly working for the SRP, the CONTRACTOR will not advertise his/her own business, will not solicit work for him/herself, and will only distribute the PHOTOGRAPHER’s materials, business cards, and name.
The CONTRACTOR is not bound by an exclusivity contract when not working directly for SRP. The CONTRACTOR may pursue other photographic work for him/herself or other studios so long as it shall not directly compete with SRP, or infringe upon the SRP's client base.
Copyright and Reproduction
The CONTRACTORS assignment is a work for hire job. As such, the copyrights of the images produced by him or her, belong to SRP. The CONTRACTOR agrees not to sell any image taken during a contracted event from SRP to any person, company, group, advertising agency or otherwise without SRP's express written permission.
SRP allow's the CONTRACTOR permission to use THEIR images taken during a contracted event with SRP for the CONTRACTOR’s personal print portfolio, website, weblog, brochures, or other advertising tools after the duration of this contract has been full filled.
Confidentiality
The CONTRACTOR understands that all materials, price lists, contracts, financial documents, agreements, and other information or documents that are given to him/her in the scope of his/her assignments, are exclusive property of SRP, and are privileged confidential information.
The CONTRACTOR agrees not to reveal this information to anyone, nor to use this information to the detriment of SRP, including to circumvent or to undercut sales.
The CONTRACTOR agrees that all materials as described above must be returned to SRP at such time as this or any subsequent contract or agreement ends.
Liability
The CONTRACTOR warrants that he/she will perform when booked for a photographic assignment , and that he/she is liable for any loss or any other financial liability suffered by SRP, due to a failure to perform, other than a documented medical emergency or "Act of Nature..
SRP is not liable for any loss or damage to the CONTRACTOR’s equipment during use at SRP events/sessions.
Intern Requirments
Because of the services/opportunities and experience provided by SRP the Contractor is required to assist SRP in the following areas as compensation:
Marketing- Contractor is required to post a CREATIVE promo for SRP on social media ONCE A MONTH, after the promotion has been approved by SRP.
Update and Assist in the client list with phone, email and address
Assist with thank you and appreciation mailers/emails to clients
In the event that SRP is comfortable (Regarding Weddings/Events that Contractor is assisting in) The Contractor will Download all images after events/weddings and delete images that are not going to be used, in accordance with SRP standards, and return to SRP within one weeks time of the event. Duration can be extended if agreed upon by both parties
Signatures
The agreement constitutes the entire agreements between both parties listed above. Any modification of this agreement must be in writing and signed by both parties. If any provision of this agreement is declared invalid, than the remainder of the agreement will remain in force and intact. This agreement is governed by the laws of the State of Colorado.
